Terms of Service
-
Acceptance of These Terms
By creating a Webs.ca account or using a site built on the Webs.ca platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.
-
The Service
Webs.ca is a website-as-a-service platform for Canadian small businesses, freelancers, and tradespeople. You build your site through structured, form-based tools rather than a drag-and-drop editor. Each paid plan includes hosting, access to the Webs.ca dashboard, and one .ca or .com domain. Email hosting is not included; we recommend a provider such as Google Workspace for business email.
-
Account Registration
You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You must be legally able to enter into a binding contract to use the service. One Webs.ca account may hold multiple sites, subject to your available seats.
-
Free Trial
New accounts receive a 14-day free trial limited to one site. No payment is required to start a trial. At the end of the trial, you must subscribe to a paid plan to keep your site active; unpaid sites are disabled but not immediately deleted.
-
Subscription, Billing, and Seats
Plans are billed annually, per site ("seat"), at the price shown at checkout or listed on our current pricing page. Payments are processed by Stripe. Additional seats may be added at any time for a prorated fee; removing seats is handled through the Stripe billing portal. Subscriptions renew automatically each year unless cancelled before the renewal date.
-
Discounts and Coupons
From time to time we may offer a discount coupon code. Coupons are honoured only for accounts we have specifically flagged as eligible, at our sole discretion, and may be withdrawn or changed at any time.
-
Cancellation and Refunds
You may cancel your subscription at any time through the Stripe billing portal. Cancellation takes effect at the end of your current billing period. When a subscription lapses, all sites on that account are disabled and stop serving publicly until the subscription is reinstated. Fees already paid are non-refundable except where required by law.
-
Your Content
You retain ownership of the text, images, and other content you upload to your site. You are solely responsible for ensuring you have the right to use that content and that it does not infringe on anyone else's rights. By submitting content, you grant Webs.ca a licence to host, store, and display it as part of operating your site.
-
Acceptable Use
You agree not to use the service to publish unlawful, defamatory, fraudulent, or infringing content, to send spam, to distribute malware, or to attempt to disrupt or gain unauthorized access to the platform or other users' sites. Content is checked against an automated list of prohibited terms; we may remove content or suspend accounts that violate this policy.
-
Custom Domains
If you connect a custom domain, you are responsible for owning or controlling that domain and for pointing its DNS records to Webs.ca as instructed. We provision SSL certificates for connected domains automatically. Requests to register a new .ca or .com domain through us are fulfilled manually and may take additional time.
-
Service Availability and Support
We aim to keep the platform available at all times but do not guarantee uninterrupted or error-free service. Support is available from 9 AM to 6 PM Eastern Time; outside these hours, an AI assistant may help with common questions, and unresolved issues are followed up the next business day. Support covers platform functionality and bugs; it does not include design or content editing help.
-
Suspension and Termination
We may suspend or terminate your account if you breach these Terms, misuse the service, or fail to pay applicable fees. You may stop using the service and cancel your account at any time. Custom domains connected to a cancelled account remain live until we disable automatic renewal.
-
Intellectual Property
The Webs.ca platform, including its software, templates, and design system, is owned by Webs.ca and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the platform itself to you.
-
Third-Party Services
The platform relies on third-party providers for functions such as payment processing, email delivery, AI-assisted design features, and content delivery and security. Your use of features backed by these providers is also subject to their respective terms.
-
Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.
-
Limitation of Liability
To the maximum extent permitted by law, Webs.ca will not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months before the claim arose.
-
Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
-
Changes to These Terms
We may update these Terms from time to time. Continued use of the service after a change takes effect constitutes acceptance of the revised Terms. If you have questions about these Terms, contact us at [email protected].
